Provider Terms of Service
These terms govern how service providers list, advertise, and interact on Kababayan Connect ("the Platform"), operated by Kangaroofern Media Lab Pty Ltd ("we", "us", "our"). By creating a provider listing you agree to these terms.
1. Eligibility
You may list as a provider on Kababayan Connect if:
- You operate a legitimate Australian business or are an authorised practitioner working in Australia.
- You hold any registrations or licenses required for your profession (MARA for migration agents, AHPRA for healthcare practitioners, TPB for tax/BAS agents, ASIC + ABR for businesses, AUSTRAC for remittance, etc.).
- You can lawfully provide the services you list.
- You are 18 or older and authorised to enter into these terms on behalf of the listed entity.
2. Verification — what the badge means
Our verified badge is a narrow factual claim, not an endorsement. When we display the badge on your listing, we are saying:
- Your registration number, as you submitted it, was confirmed against the relevant public register on the date shown.
- The register name and a link to the public register page are displayed so users can independently verify.
We do NOT claim:
- That you are "trusted", "approved", or "recommended" — these subjective phrases are prohibited under Australian Consumer Law in this context.
- Anything about your service quality, fees, or fitness for any particular purpose.
- That registration cannot be revoked by the issuing body. We re-check registrations periodically; if your registration lapses, the badge is removed.
3. Your listing content
You are responsible for everything you publish on your listing. Content must:
- Be accurate and current. Misleading or deceptive conduct is prohibited under section 18 of the Australian Consumer Law and we will remove non-compliant listings without notice.
- Reflect services you actually provide. Don't list services outside your scope of practice or registration.
- Avoid prohibited claims. No "guaranteed visa approval", "fastest in Australia", "best Filipino [profession]". These are unverifiable and can attract regulator action.
- Respect intellectual property. Only upload images and content you own or are licensed to use.
- Comply with profession-specific advertising rules. For example: AHPRA practitioner advertising guidelines, MARA Code of Conduct, TPB Code of Professional Conduct.
4. Reviews
Reviews are user-generated. We moderate for spam and abuse but we do not curate reviews to favour any provider. We do not write, simulate, or manufacture reviews.
You may not:
- Solicit reviews in exchange for discounts, payment, or other benefits without the reviewer disclosing this on the review itself.
- Submit fake reviews about your own listing or competitors' listings.
- Threaten, retaliate against, or attempt to identify reviewers.
These behaviours are misleading or deceptive conduct under the ACL and grounds for immediate listing removal.
5. Lead handling and response time
When a kabayan messages you through the platform, you agree to respond within 48 hours or set an out-of-office message. Repeated non-response is grounds for listing suspension.
6. Fees
Listings are currently free. Featured placements and lead-delivery upgrades may be introduced in future and will be opt-in. We will provide at least 30 days' notice and updated terms before introducing any provider-side fees.
7. Suspension and removal
We may suspend or remove your listing without prior notice if:
- Your registration is no longer current with the relevant public register.
- Your listing contains misleading, deceptive, or prohibited claims.
- Multiple credible scam reports or unresolved disputes are filed against you.
- You violate these terms or any applicable law.
You can request reinstatement by addressing the issue and contacting us. We are reasonable. Regulatory complaints filed against your registration are out of our control and will result in immediate badge removal until cleared.
8. Liability and warranties
Your relationship with clients is between you and them. We facilitate discovery and trust signalling — we are not a party to any service agreement you enter with a kabayan.
To the extent permitted by law, we exclude all warranties not expressly given. Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot be lawfully excluded.
You agree to indemnify us against claims arising from your listing content, your services to clients, or your breach of these terms.
9. Closing your account
You can close your provider account at any time from your dashboard. We will unpublish your listing within 24 hours. Reviews you have received will remain attributed to the original review authors unless they request removal — we cannot delete user-generated content on your behalf.
10. Changes to these terms
We will email registered providers at least 14 days before making material changes. Continued use after the effective date constitutes acceptance.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
